Welcome to the HUDMAX.com website. This website, and the information, content, services and products it makes available (collectively, the “Site” or HUDMAX.com), is provided to you by Heavy Hammer, Inc., a Maryland company.
Modifications to this Agreement
From time to time, in our sole discretion, we may make changes to this Agreement by updating this posting on the Site. At such time, we will specify the effective date of the new version of the Agreement. Your continued use of HUDMAX.com following the posting of a new version of the Agreement constitutes your acceptance of the new version of the Agreement, including all changes thereto.

Membership and Discontinuation of Services
Service will begin the day the first payment is made. Services include the member’s banner being placed in the geographic area(s) being paid for. Further services include leads that are generated in the geographic area(s) being forwarded in real time to the email address provided by the member on initial sign up. The member has the ability to change this email address at any point during their membership period and may also change any other contact information on their banner including but not limited to phone number(s), name presented, brokerage, or associated professional group by contacting Client Services at 800-880-8584 or
The USHUD Cooperative reserves the right to adjust, modify, increase, decrease, restructure, or otherwise change pricing, recurring billing amounts, setup fees, advertising rates, membership dues, service fees, and/or plan structures at any time and in its sole discretion, with or without prior notice to the member. The member understands and agrees that continued participation in the Cooperative and continued use of services constitutes acceptance of any such pricing adjustments. Pricing adjustments shall not constitute grounds for cancellation of any active term commitment, payment obligation, or refund request.
Members warrant and agree as professional members of HUDMAX.com and its family of sites that they approve the charges to their credit card or bank account. As a professional member of HUDMAX.com the member understands that automatic billing will occur on the same day of each following month unless otherwise agreed in writing. Automatic billing can be suspended or canceled by the member by contacting Client Services at
Normal business hours are 9:00 AM to 5:00 PM EST, Monday through Friday except for holidays or due to inclement weather.
Suspension of Service / Refund Policy
No refunds or cancellations during billing cycles are approved. If the member wishes to suspend service and avoid future billings it is agreed that it is incumbent upon the Cooperative member to email the Cooperative at
Billing occurs monthly in most cases; however, the agreed timeframe of each subsequent cooperative term commitment will generally occur in 90-day blocks unless otherwise specifically communicated and mutually agreed upon via recorded call or in writing.
The USHUD Cooperative reserves the right to refer any unpaid portion of membership dues to third-party collections or any legal method of collection including bank processing expenses, legal expenses, and collection fees incurred by the Cooperative.
Disclaimer of Warranties and Limitation of Liability
YOU ACKNOWLEDGE THAT YOU ARE USING THE SITE AT YOUR OWN RISK. THE SITE, MATERIALS, SERVICES, CONTENT, SOFTWARE, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
HUDMAX.COM, ITS OWNERS, AFFILIATES, LICENSORS, SUPPLIERS, EMPLOYEES, CONTRACTORS, AND RELATED PARTIES DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND COMPLETENESS.
IN NO EVENT SHALL HUDMAX.COM OR ITS RELATED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM THE USE OF THE SITE OR SERVICES.
Ownership and Intellectual Property Rights
All content, trademarks, service marks, logos, trade names, graphics, and software associated with the Site are owned by HUDMAX.com, Heavy Hammer, Inc., or their licensors and are protected by applicable intellectual property laws.
Advertising and Consumer Communications
Exclusive Banner placement indicates that an advertiser’s banner will not rotate with competing advertisers in the designated primary geographic area while the advertiser’s account remains active and current.
Courtesy areas are not guaranteed for any specific period of time unless otherwise agreed in writing.
Consumer contact forms are sent electronically in real time and may be forwarded to third parties after twenty-four hours in order to ensure consumer follow up.
Modification or Suspension of the Site
HUDMAX.com may at any time modify, discontinue, suspend, or terminate operation of the Site or any portion thereof without notice.
Applicable Law
This Agreement and any disputes relating to this Agreement or the Site shall be governed by the laws of the State of Maryland. Any legal proceeding shall be brought exclusively in a court of competent jurisdiction sitting in Montgomery County, Maryland.
Severability
If any provision of this Agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms of Use constitute the entire agreement between the member and HUDMAX.com concerning use of the Site and services and supersede all prior agreements or understandings.
